Terms and Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:

Withdrawal period : the period during which the consumer may exercise their right of withdrawal.

Consumer: a natural person who is not acting in the course of a professional or commercial activity and who enters into a distance contract with the company.

Day: one calendar day.

Contract for successive performance: a distance contract concerning a series of products and/or services whose delivery or receipt obligations are spread out over time.

Durable medium: any means allowing the consumer or business to store information addressed to them personally, so that they can consult it later and reproduce it without modification.

Right of withdrawal: the possibility for the consumer to terminate the distance contract within the cooling-off period.

Company (or “the seller”): the natural or legal person who offers products and/or services remotely to consumers.

Distance contract: a contract concluded as part of a distance selling system organized by the company, without the simultaneous physical presence of the consumer and the seller.

Terms and Conditions: These are the terms and conditions of sale for Sarah & Claire Montreal.

Article 3 – Scope of application
These general terms and conditions apply to all offers made by Sarah & Claire Montreal and to all distance contracts concluded between the company and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer.
If this is not reasonably possible, it will be indicated where these terms and conditions can be consulted electronically and that they will be sent free of charge upon request.
When the contract is concluded electronically, Sarah & Claire Montreal guarantees that the text of the terms and conditions can be easily saved on a durable medium.
Situations not covered by these terms and conditions shall be interpreted in accordance with the “spirit” of the terms and conditions.
Article 4 – The offer
If an offer has a limited validity period or is subject to certain conditions, this will be clearly indicated.
All offers are non-binding. Sarah & Claire Montreal reserves the right to modify or adapt the offer.
Product and service descriptions are carefully written to enable consumers to make informed assessments.
Photographs are an accurate representation of the products offered, although colors may differ slightly from reality depending on the screen used.
Each offer specifies:

The price, excluding any customs duties and import VAT, payable by the customer.

Any delivery charges.
-
The method of concluding the contract.

The right (or not) of withdrawal.
-
Payment, delivery, and performance terms.

The offer's validity period.
Article 5 – The contract
The contract is concluded when the consumer accepts the offer and fulfills the corresponding conditions.
An electronic confirmation is immediately sent to the consumer.
In the case of electronic payment, Sarah & Claire Montreal implements appropriate security measures.
The company reserves the right to refuse an order or impose special conditions in case of doubt about the customer's solvency.
After the contract has been concluded, the consumer will receive the following information:

The address of the head office for complaints.

Conditions for exercising the right of withdrawal.

Information on warranties and after-sales services.

The information contained in Article 4.
Article 6 – Right of withdrawal
The consumer has a period of 30 days to withdraw without justification.
This period begins the day after receipt of the product.
During this period, the consumer must handle the product and its packaging with care.
If they wish to exercise their right of withdrawal, they must inform Sarah & Claire Montreal by Email to: info@sarahandclairemontreal.com.
The product must be returned in its original condition, with all accessories, preferably in its original packaging.
Return shipping costs are the responsibility of the consumer, including in the case of returns to suppliers abroad.
Article 7 – Refunds
If the consumer has exercised their right of withdrawal, Sarah & Claire Montreal will refund the amount paid within 30 days of receiving the returned product or upon presentation of proof of shipment.
Article 8 – Exclusions from the right of withdrawal
The right of withdrawal does not apply to:

Products manufactured according to consumer specifications.

Customized items.
-
Products sealed for hygiene reasons, when the seal has been broken.
-
Perishable goods.
-
Digital downloads or services already commenced before the end of the withdrawal period.
Article 9 – Price
The prices quoted will not be increased during the period of validity of the offer, except in the event of a change in the VAT rate or other legal regulations.
All prices are exclusive of any customs duties and import VAT, which will be invoiced directly to the customer by the carrier.
Article 10 – Conformity and warranty
Sarah & Claire Montreal guarantees that the products comply with the contract and with current quality and safety standards.
Any defects must be reported within 30 days of receiving the product.
Returns must be made in the original packaging and in perfect condition.
Article 11 – Delivery and performance
Sarah & Claire Montreal will take the utmost care in receiving and processing orders.
Products will be delivered to the address provided by the consumer.
Orders are usually delivered within 5 to 14 business days.
In the event of a delay or unavailability, the consumer will be notified and may cancel their order at no cost.
Article 12 – Term and termination
Permanent contracts may be terminated at any time with one month's notice.
Fixed-term contracts cannot be automatically extended.
Article 13 – Payment
Unless otherwise agreed, payment must be made within 7 business days after order confirmation.
In case of non-payment, Sarah & Claire Montreal reserves the right to charge legal collection fees.
Article 14 – Complaints
Complaints must be sent within 7 days of discovering the defect, by email to: info@sarahandclairemontreal.com
Complaints will be processed within a maximum of 30 days.
If the complaint is justified, Sarah & Claire Montreal will replace or repair the product free of charge.
Article 15 – Disputes
Contracts concluded with Sarah & Claire Montreal are governed exclusively by Dutch law, even if the consumer resides abroad.
